Welcome to Deepcab. These Terms & Conditions (“T&C”) govern all access to our website, purchases of our products, and any transactions between Deepcab (“Company,” “we,” “us,” “our”) and the customer (“you,” “your,” “Customer”). By accessing our website, placing an order, or transacting with us, you confirm that you have read, understood, and agreed to be bound by these T&C. If you do not agree, you must refrain from using our services or purchasing our products.
Orders & Acceptance
- All orders placed with us are subject to acceptance. An order is deemed confirmed only upon written acknowledgement (via email, invoice, or other official communication) by us.
- We reserve the right to accept, reject, or cancel orders at our sole discretion, including cases of incorrect pricing, unavailability of stock, or suspicion of fraudulent activity.
- If fulfilment of an order is delayed due to factors beyond our reasonable control (including but not limited to raw material shortages, supply chain disruptions, strikes, natural disasters, or government restrictions), we will notify you promptly and may offer revised timelines, substitutions, or a refund if cancellation is requested.
Product Specifications & Suitability
- All products are manufactured in accordance with applicable IS, IEC, and relevant industry standards.
- Specifications, designs, or models are subject to change without prior notice as part of our continuous improvement process.
- While we provide product details for guidance, it is solely the Customer’s responsibility to verify and ensure that the selected product is fit for its intended application, usage conditions, and compliance with applicable laws and standards.
- Any technical advice, recommendations, or support provided by us is advisory in nature and does not constitute a guarantee of suitability.
Pricing, Payment & Ownership
- Prices displayed or quoted are exclusive of applicable taxes, duties, levies, freight, and insurance charges, unless expressly stated otherwise.
- Payments must be made in full as per the agreed terms. Payment delays may attract interest at prevailing commercial lending rates, without prejudice to our right to recover outstanding amounts.
- Ownership of products shall transfer to the Customer only upon receipt of full and final payment. Until then, all products remain our property.
- In case of non-payment, we reserve the right to suspend future deliveries, cancel pending orders, or reclaim goods supplied.
Delivery, Shipping & Risk
- Delivery dates provided are estimates only and may be impacted by production schedules, transportation delays, or unforeseen circumstances.
- Delivery is considered complete once the products are handed over to the carrier, at which point risk of loss or damage passes to the Customer.
- Customers are responsible for providing accurate delivery details. We are not liable for delays, losses, or costs arising from incorrect or incomplete information.
- Insurance of goods in transit shall be the Customer’s responsibility unless otherwise agreed in writing.
Warranty, Returns & Claims
- Our products are warranted against manufacturing defects for the warranty period specified in our official policy.
- The warranty does not cover damage due to:
- Improper storage, handling, or installation
- Use of products beyond rated specifications
- Unauthorized modifications or repairs
- Normal wear and tear, accidents, or negligence
- Claims for shortages, visible damages, or defects must be notified in writing within seven (7) days of receipt. Claims beyond this period may not be entertained.
- Returns will only be accepted with our prior written authorization. Unauthorized returns will be refused.
- In case of a valid warranty claim, our liability shall be limited to repair, replacement, or refund (at our discretion).
Limitation of Liability
- To the fullest extent permitted by law, our liability shall be limited to the invoice value of the goods supplied.
- We are not liable for indirect, incidental, special, or consequential damages (including loss of business, profit, or goodwill), except where mandatory law prohibits such exclusion (e.g., personal injury caused by negligence or fraud).
- The Customer agrees to indemnify and hold us harmless against any claims, damages, or liabilities arising from misuse, improper application, or resale of our products.
Intellectual Property Rights
- All trademarks, trade names, logos, designs, and product branding—including “Deepcab”—are the exclusive property of the Company.
- No license, right, or interest is granted to the Customer to use our intellectual property without prior written consent.
- Unauthorized reproduction, modification, or distribution of our designs or materials may result in legal action.
Compliance, Use & Restrictions
- Customers must ensure that installation, usage, and handling of our products comply with applicable laws, electrical codes, safety guidelines, and regulatory standards.
- Our products may not be altered, re-engineered, rebranded, or used for unlawful purposes.
- We disclaim any liability arising from misuse or application of products outside their intended scope.
Unforeseen Events
- We shall not be held liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, lockouts, war, government restrictions, transport disruptions, or power outages.
- In such cases, obligations may be suspended or extended for the duration of the event, without penalty.
Transfer & Assignment of Rights
- We may assign or transfer our rights and obligations under these T&C without affecting the Customer’s rights.
- Customers may not transfer or assign their rights or obligations without our prior written consent.
Governing Law, Jurisdiction & Dispute Resolution
- These T&C shall be governed by and interpreted in accordance with the laws of India.
- Any disputes arising under or in connection with these T&C shall fall under the exclusive jurisdiction of the courts located in Delhi/NCR, India.
- Any claim or action must be brought within seven (7) days from the cause of action, unless a longer period is mandated by law.
- Parties are encouraged to resolve disputes amicably through negotiation or mediation before seeking judicial remedies.
Amendments
